10 Benefits Of Live In Relationship & Indian Laws Governing It

0

What is a live-in relationship?

It can be defined as couples living together without being married to each other legally. It can also be termed domestic cohabitation between two unmarried individuals. Nowadays individuals are choosing live-in relationships over marriage, it has become quite prevalent among the young couples living in metropolitan cities.

There are a few disadvantages of a live-in relationship in India where the constitution of marriage is considered sacred and is legally and socially accepted in society. But there are a lot of benefits of a live-in relationship.

live-in relationship benefits

Let’s discuss some of the benefits of a Live-In Relationship:

1. Testing the waters

One of the main objectives and advantages of a live-in relationship is to check your compatibility with your partner. It takes time to know about a person and the best way to do that would be to spend ample time with your partner, and what better way to do so other than living with your partner under the same roof. This way you will get an idea about the real personality of the person and understand if you are compatible or not. It is better to find that out before getting married.

2. Financial Stability

The financial status of an individual is more flexible in a live-in relationship than in a marriage. You have the independence to take your own financial decisions without consulting your partner every time, it doesn’t have to be a joint exercise as both the partners don’t have to live with that decision. You also don’t have to spend huge amounts of money on dates as you will be living together and won’t have to pay for legal divorce procedures even if you want to get separated later.

3. Respect and Efforts

Since live-in relationships are more volatile, they need more effort to keep things afloat. As in this relationship both the partners are independent in terms of social obligations and finance, the possibility of ending the relationship would be hassle-free so one has to put extra effort to keep things going with less possibility of taking each other for granted. The mutual respect for each other would be strong.

4. Equal and Practical Responsibilities

Most of the time the responsibilities of marriage are based more on conventions and less on compatibility. In a live-in relationship, you don’t have to take part in certain impractical responsibilities that come with marriage. Since live-in comes with freedom of certain responsibilities, your responsibilities will be based on your needs and they will be equal and practical for both partners.

5. Free from societal norms and diktats

In a live-in relationship, you don’t have to worry about pleasing each other’s families and feel the pressure of putting someone before you. As you are not bound by any rules and conventions, it gets easier to maintain personal space and not make compromises. You also get the freedom to walk out of the relationship more easily if things go wrong.

6. Not taken for granted

A live-in relationship has some practical benefits, it makes individuals appreciate each other more and respect each other’s efforts to maintain the relationship that keeps the spark between the two. Generally, after marriage, the spark dies down eventually due to the responsibilities and burdens of commitment.

7. Not getting the stamp of a divorcee

Divorce is a huge taboo, especially in a country like India. Divorcees are looked down upon in society. When you are in a live-in relationship, you are not bound by any legal customs and you don’t have to go through the legal procedures of a divorce if you want to split up.

8. Insight about your married life

When you stay in a live-in relationship with your partner, after a certain period of time, you begin to understand if you are ready for a long-term relationship like marriage with that person or not.

9. Good Intimacy

In India, the idea of nuclear families is catching up, but most of the time, even after marriage most couples have to live with their parents, and couples living by themselves are considered impractical. The freedom of romance and intimacy takes a back seat in such scenarios. The initial years of a relationship are the most exciting and the romance and physical intimacy should be free from family commitments and social obligations which is possible in a live-in relationship.

10. A failed relationship is better than a failed marriage

At the end of the day, if you find out that you are not compatible with each other or you cannot picture yourself with the person for the rest of your life, it will be easier for you to get out of the relationship than it would have been if you were married.

Confused? Check Out The Do’s And Dont’s Of A Live-In Relationship

In India, the age-old customs and traditions are strictly followed and it is difficult for Indian society to accept any changes in the modern age. Though some people have accepted it, some are still hostile towards it. We are often curious and unaware of the Indian Laws governing the subject of live-in relationships. Is it illegal in India? What are the guidelines that regulate such relationships?

Let’s Talk About Some of The Indian Laws Governing Live-in Relationships

A live-in relationship is not illegal in the eyes of the law.

Protection of Woman from Domestic Violence Act, 2005

“(a) relationship between two persons who live or have, at any point of time, lived together in a shared household, when they are related by consanguinity, marriage, or through a relationship in the nature of marriage, adoption or are family members living together as a joint family.”

In the case above, the words ‘relationship in the nature of marriage’ encloses within itself live-in relationships.

Under section 2(s) of Protection of woman from Domestic Violence Act, 2005.

If two consenting adults are living together in a domestic relationship sharing the same household as a couple, they are in a live-in relationship. The court has taken into account the two expressions, “shared household” under this section to protect the women in a live-in relationship.

under section 2(f) of Protection of woman from Domestic Violence Act, 2005

The expression “domestic relationship” under this section is applicable to people who reside in a live-in relationship and not only to the couple who are married. A live-in relationship is nothing but the court has considered it as a relationship in the nature of marriage as given in section 2(f).

Rights Of Women Partners And Children In A Live-In Relationship

The Right to Maintenance under Section 125 of the Cr.P.C.

After the recommendations of the Malimath Committee on Reforms of Criminal Justice System to amend Section 125 of the Cr.P.C., the Court adjudged that the woman was entitled to maintenance for herself and the children born to them and to change the meaning of ‘wife’ therein, a revision was made. As per the current legal position, women who have subsequently been abandoned by their partner after their live-in relationship, enjoy the status of a wife.

In Chanmuniya v. Virendra Kushwaha, the Supreme Court overruled the previous verdict that upheld the right of a woman in a live-in relationship to claim maintenance under Section 125 of the Cr.P.C. The reason behind entitling a woman in a live-in relationship to such a right is to make sure that a man does not take advantage of legal loopholes by enjoying the benefits of a live-in relationship (de facto marriage) without fulfilling the responsibilities of that marriage.

In Kamala v. Mohan Kumar, the Hon’ble Supreme Court had expressed that the term ‘wife’ should be given a purposive interpretation to further the principles of social justice and uphold the right to dignity of individuals enshrined in the Constitution. In this instance, the Court adjudged that the woman was entitled to maintenance for herself and the children born to them because a long cohabitation between woman and man led to the presumption of marriage.

Section 125 of Code of Criminal Procedure, 1973

Under section 20(1) (d) of Protection of Woman from Domestic Violence Act, 2005

By way of judicial interpretation, women can also seek maintenance under the above-mentioned Act, the court has granted the maintenance to the female residing in the live-in relationship.

Hindu Succession Act, 1956

After the amendment of the Act in 2005, women are entitled to inherit self-acquired property and ancestral property just like that of a son irrespective of her marital status.

Under the  Section 10 of the Hindu Succession Act, 1956

By way of inheritance, the woman in a live-in relationship was allowed to receive the property from her partner just like a widow gets the husband’s share.

Legal Status of the Child Born Out of Live-In Relationship

The right of inheritance of the children and provide for the legitimacy of a child or the legal status of a child even for an illegitimate one is dealt with by Section 16 of the Hindu Marriage Act, 1955, thus, the inheritance rights are in favor of the children born out of a live-in relationship.

Section 114 of Evidence Act, 1872

As observed in the case of S.P.S Balasubramanyam v.  Suruttayan, by virtue of the Act mentioned above the child born out of a live-in relationship will not be considered an illegitimate child.

Finding the perfect Instagram username can be challenging, the struggle is real! The first thing someone comes across on Instagram is your username, so it is really important to pick something that is unique and relates to your personality, brand, and niche. Besides coming up with something that is catchy and relevant which will define your first impression, the username needs to be discoverable too. The list of requirements for that “perfect” username is never-ending. We are here to guide you to make the process a little easier. So, let’s get started:

What is your profile for?

Your Instagram username hugely depends upon the type of account you have or the purpose of your account. 10 Most Shocking Revelations From Cricketers That Stunned The Sports World

0

Controversies in the sports world including cricket are not unknown, while some die down in the process, some are worth investigating. Here are some of the shocking revelations by cricketers that shook the entire sporting world.

1. The most disturbing and unexpected revelation was made by Yuzvendra Chahal, the King of controversies in the cricket world.  Recently in a Rajasthan Royals video, his current team, Chahal revealed that he was once dangled from the 15th floor of a building by a drunk player of MI in 2013. He said:

My story, some people know about. I have never spoken about this, I never shared this. In 2013, I was with the Mumbai Indians. We had a match in Bengaluru. There was a get-together after that. There was a player who was very drunk, I will not take his name. He was very drunk; he was looking at me and he just called me. He took me outside and he dangled me from the balcony

2. Besides the 2013 event, Chahal once said that in 2011, Andrew Symonds and James Franklin tied him up completely and taped his mouth, and forgot that they had left him in that state all night. Here’s is what he said:

It was in 2011 after winning Champions League in a Chennai hotel. He [Andrew Symonds] had drunk a lot of “fruit juice” (laughs). I was with him, only. James Franklin and he tied my hands and legs, and said ‘now you have to open’. They were in so much masti they have taped my mouth and forgot all about me. Party got over and in the morning, when a cleaner came, he saw me and freed me. They asked from when have I been here like this and I told them, ‘from the night itself’.

3. Pakistani cricketer Danish Kaneria once said that his teammates refused to eat at his place because of his religion. He added that among some other senior players, Shoaib Akhtar, treated him well and he was thankful for that.

The players who didn’t like to talk to me just because I was a Hindu. Soon I will reveal their names. I did not have the courage to speak in this regard, but now I got the courage to speak on this issue when I heard Shoaib’s statement.

Not only in Pakistan, but Religious discrimination also runs deep in society all around the world – including our country.

4. Robin Uthappa once revealed keeping the person’s identity anonymous, that after the inaugural season of the IPL, he was made to sign papers forcefully to leave Mumbai Indians. He added that he was threatened to do so.

So, I was along with Zaheer Khan and Manish Pandey. I was one of the first people to be transferred in the IPL. For me, it became extremely difficult because my loyalties were completely laid out with MI at that point. It happened a month before the IPL and I refused to sign the transfer papers. Someone from MI, I won’t name him, had told me that if I didn’t sign the transfer papers, I’d not get to play in the XI for MI.

5. Wriddhiman Saha was once threatened by a journalist who said “this wasn’t something you should have done” when the cricketer posted a screenshot of the texts.

Later BCCI initiated a probe to look into the matter. Later, it was admitted by the journalist Boria Majumdar that he had sent those texts to Saha.

6. In 2019, Harbhajan Singh revealed that the management in order to build a new team forgot about the experienced players. He said that many senior players, like VVS Laxman and many others, had to leave cricket for this though some of them were even World Cup winners.

Many players from the 2011 World Cup could have played the next World Cup. Like Me and Yuvi, Gambhir, certainly we could have played the next world cup but we were dropped. I don’t know what was the agenda of leaving us all aside. It was like your work is done now you can leave. We have to make a new team. Why do you need a new team? You need it when the team has not won. We won the World Cup and you should take the team forward.

Harbhajan Singh

7. Darren Sammy was once called “ka*lu” by players in the IPL, a very unfortunate incident.

In hindsight, asking for apology I shouldn’t have even done that. If me and my team-mates have done something not intentionally, but now I realise that could be deemed or termed as something that could be hurtful to a team-mate of mine. So whether I get an apology or not, it doesn’t change the mentality of how proud I am to be a black person, to be a black man. It doesn’t change.

8. During Ashes 2015, an Australian player called an English cricketer Moeen Ali “Osama”. Moeen revealed the disgusting case of racism but refrained from taking his name.

It was a great first Ashes Test in terms of my personal performance. However there was one incident which had distracted me. An Australian player had turned to me on the field and said, ‘Take that, Osama.’ I could not believe what I had heard. I remember going really red. I have never been so angry on a cricket field.

9. When Virat Kohli stepped down from the position of the skipper in the T20s he revealed that there was no talk of ODI captaincy with BCCI which was contradicted by Sourav Ganguly’s comments, who had said that as Kohli was insistent on quitting as T20 captain, ODI leadership was also taken away from him for the sake of consistency across limited-over formats.

10. Later, it was reported that a show-cause notice was sent to Virat Kohli by Ganguly which was turned down by the board because the team was going to South Africa for a tour. This claim was denied by Sourav Ganguly.

Dinesh Karthik Responds To Sachin Tendulkar After He Applauds Him For His Performance

0

The veteran Indian cricketer, Dinesh Karthik, who previously led Kolkata Knight Riders (KKR) was released by the franchise before the mega-auction of the IPL 2022 due to the poor performance of the team. This season he is playing for the IPL team Royal Challengers Bangalore and he is in his best form in the IPL 2022. Everyone is impressed by his emergence as a finisher for his team in the tournament.

The wicketkeeper-batsman cost RCB Rs. 5.5 crore and the audience can see that he is trying his level best to justify his purchase. In the five matches that RCB played till now, Dinesh Karthik has remained not out four times with scores of 32*, 14*, 44*, 7*, and 34. RCB has won three out of the five matches they played in the tournament. DK’s performance made many cricket fans suggest that he should be included in the national team as this will certainly increase the chances of India winning the T20 World Cup and India’s search for a finisher will be over.

Dinesh Karthik’s performance was praised by many former cricketers such as Sunil Gavaskar, Ravi Shastri, and others besides his teammates. However, Karthik’s most cherished appreciation is from none other than the legendary former Indian cricketer Sachin Tendulkar.

A video has been uploaded on Youtube and the 100 MB app where Sachin Tendulkar is seen saying that in the form of Dinesh Karthik who is a 360-degree player whether he plays against spin or pace, RCB has a very lethal player. Sachin Tendulkar further added that DK first reads the line and length of the ball and then he plays the shot accordingly before he starts attacking, he begins from the very first ball and he doesn’t make up his mind early about hitting the ball. According to Sachin Tendulkar, at the present time, there are very few batsmen in the cricket world who can read the line and length of the ball as quickly as DK.

You can hear Sachin Tendulkar praising Dinesh Karthik in this video clip posted with the caption,

“‘There are not many right now who are picking up line & length of a bowler so quickly like @DineshKarthik has been doing’

Watch what @sachin_rt had to say about Dinesh Karthik’s unreal form! #IPL2022”🔥

This is one of the proudest moments of DK’s life and he responded with, “That feeling of being on cloud 9 when the G.O.A.T of cricket appreciates you”.

Will RCB win the IPL this season?

Harbhajan Singh Takes A Massive Dig At Dhoni For The 2011 World Cup Win

0

Recently Harbhajan Singh made a huge statement regarding the World Cup 2011, which is being discussed a lot. Harbhajan Singh played for Team India as well as in the IPL under the captaincy of Mahendra Singh Dhoni.

In the Indian Premier League (IPL 2022) Harbhajan Singh is seen in the role of a commentator. Recently he came up with a statement regarding the ICC Cricket World Cup 2011, targeting Dhoni which created quite a buzz on the internet. The Indian team won the World Cup against Sri Lanka in the final match where Dhoni scored an unbeaten 91, smashed a number of sixes, and was also declared Man of the Match at Wankhede Stadium in Mumbai, India.

Meanwhile, Dhoni getting all the praise for India’s World Cup win didn’t go down well with many former cricketers who were also a part of the World Cup-winning side. Recently, former India spinner Harbhajan Singh questioned the credit given to Dhoni for India’s 2011 World Cup triumph.

When former Indian cricketer Mohammad Kaif said how Delhi Capitals had played their first-ever IPL final under the present-KKR skipper Shreyas Iyer in 2020. Harbhajan asked, “Were the rest of the players playing gulli-danda?” in a disagreement with Kaif’s comments. Then he went on to bring up the example of Dhoni getting credit for India’s 2011 World Cup win.

He also said that if according to India winning the World cup headlines, only Dhoni was credited for the Indian team winning the World cup, he asked then what about the contribution of the other team members who also worked hard to win as a team.

He further revealed that cricket is a team game of 11 players where a single player cannot be solely responsible for its win. The team moves forward when at least 7-8 players out of the 11 play well.

In an event on Star Sports, Harbhajan Singh said,

“When Australia wins the World Cup, the headlines are that the Australian team won the World Cup and when India won the World Cup, the headlines everywhere were that Mahendra Singh Dhoni has won the World Cup. So what about the rest of the team? All these other players went there to drink lassi”

The veteran cricketer further added,

“What did the other 10 players do in that match? What did Gautam Gambhir do? The thing is, this is a team game. 7-8 players will play well when there are 11 players in the team. Only then will your team move forward”

Watch the video:

Dhoni remains the only captain to have won all three major limited-over ICC trophies as a skipper. He is the one who led India to memorable triumphs at the 2007 T20 World Cup, 2011 ODI World Cup, and the 2013 Champions Trophy.

Paytm’s CEO Vijay Shekhar Sharma Praised Foreign Minister On His Comment On Ukraine & Russia

Foreign Minister Dr. S Jaishankar recently responded to a question on India’s energy imports and the country’s response to the war in Ukraine. His response is winning praises from everyone including Paytm CEO Vijay Shekhar Sharma. Dr. S Jaishankar who is in the US for the fourth India-US 2+2 Ministerial Dialogue said, India’s total purchase of oil from Russia in a month is probably less than what Europe does in an afternoon.

When a reporter questioned him on India’s stand on Russia’s invasion of Ukraine, Dr. S Jaishankar said, “I prefer to do it my way and articulate it my way”

“…we have made a number of statements which outline our position in the UN, in our parliament, and in other forums. And briefly, what those positions state is that we’re against the conflict; we are for dialogue and diplomacy; we are for an urgent cessation of violence; and we are prepared to contribute in multiple ways to these objectives.”

The minister’s sharp response at the briefing was praised by Paytm chief Vijay Shekhar Sharma.

Sharma tweeted on Monday: “Our Indian team at international diplomacy is simply the best. What an incredible answer by MEA”

Dr. Jaishankar also responded when asked about why India continues to buy oil from Russia, he told the reporter,

“I noticed you refer to oil purchases. If you are looking at energy purchases from Russia, I would suggest that your attention should be focused on Europe. We do buy some energy, which is necessary for our energy security. But I suspect looking at the figures, probably our total purchases for the month would be less than what Europe does in an afternoon”

Besides winning praises for his comments at the joint briefing, Ajay Rotti, a partner at tax and regulatory firms Dhruva Advisors, shared Dr. Jaishankar’s quote from another event, with an aim to set up a “Dr. S Jaishankar Fan Club”.

Ajay Rotti tweeted:

“I am looking for co-founders for a ‘@DrSJaishankar Fan Club’. People who are interested can reply to this tweet.”

The Paytm boss, Vijay Shekhar Sharma also responded to his tweet, saying,

“Ye”, along with a raised hands emoji. “I wonder why there are not enough articles and twitter threads on his skills to manage tough situations and profound answers.”

Edelweiss CEO Radhika Gupta also commented on Sharma’s Tweet, “Yes. Master class on communication and handling prickly situations with confidence”

The Rajya Sabha MP also took to Twitter and posted a video of his comments, and tweeted “Superb from EAM”.
